What recourse does one have when the grille on your car gets damaged by a loose shopping cart that flew into the employee parking area? There's probably nothing I can do outside of Gorilla Glue and Duct tape but am interrested in feedback. Thank goodness my car already is 15 years old but it still looks sad.

Very little recourse. Lowe's is not responsible for damage to cars in the parking lot unless they are guilty of gross misconduct. And ... are you an employee of Lowe's? Do you want to STAY an employee of Lowe's? If so, then you better get out that duct tape and Gorilla glue buddy.

Pretty much what boardwalkties said. Lowes holds no responsibility for their carts, and I would get out the Duct tape and Gorilla Glue.

The same thing happened to me on my SECOND day. I was so pissed. A car got attacked by a blue lumber cart and left a HUGE divet in the front bumper. What was I going to do? Bitch on my 2nd day? Nope, still driving around with the huge dent in it.

No recourse because it's private property. i know in my state you can't even file a police report against another driver if he hits your car in a parking lot.

I know our store has paid for damage to cars from carts, it touch and go with employees cars though. Some employees have gotton paid for the damage, but others have not.

I'm surprised they have paid for any damages to cars from carts on the lot.
Under Lowe's general liability insurance policy, I believe they are not responsible for cart damage on the parking lot unless, for instance, a store employee is retrieving carts to go back into the store and he hits a car with the carts.

I don't know if it the laws around here or if our Lowe's store goes ahead and pays for the damage even though they are not obigated too to keep the customers and employees happy. It falls under our general liabilities which we talk about every week in our manager meetings.

No recourse at all. Lowe's is not responsible for any damages that may incur to any cars in the parking lot.

Well ... maybe I can understand paying for damage to a customer's car to keep them happy (although they're not obligated to do so), but to pay for damage to an employee's car to keep an employee happy ... no f'n way.

I know in the State of Ohio, and actually I think that in most states the business can be held resposible if the circumstances are right. The we are not resposible signs don't mean squat in court. If carts are being retrieved on a timely manor the company will probably be ok. But if carts are not being retrieved and there are carts all over the lot, there is a very good chance that Lowes will loose in court. But as was already stated, if you want to keep your job at lowes, I wouldn't press the issue.

I agree with you. Lowe's has to show some due diligence in seeing that the carts are timely removed from the parking lot in order to avoid liability.

Actually, my car doesn't look too bad with the duct tape. I was tempted to make one of those "no banging" signs but in this area of NY "banging" has multiple meanings...if you know what I mean.

I worked at Lowe's during college and in Tennessee that law doesn't exist. They might help a customer if one of the employees damaged their car... At my Lowe's though all of our rights as human beings and customers were terminated the second we accepted the job. They would rather eat dirt than help an employee in any way at my store. Of course if they thought giving away an employee car to make a big sale would work, you would walk home!

same here...and other chains too.
I can see arguments if carts were clear colored or blended in but they don't.
No carts should ever leave the property THEN that can be a huge problem. There's a supermarket I won't mension that right by their hq they let things go all over the place. people use them to cart groceries home!

We have a supermarket chain here that has an electronic sensor on all the wheels on their carts with sensors on the parking lot. If a cart strays off the parking lot, the wheels on the cart lock up. Sort of like the dog electronic fence guard thing.

That certainly would be interesting here. That also reminds me one guy wanted to take a blue cart home with them! Not to keep but he lived down the street and it was a heavy item. I can sympathise but it just isn't worth it. A blue cart on streets could take out tires...
here we have some scanners people can use and when they get to checkout they can just pay and go. It also gives signals if there's any deals as they walk by them. It can be OK if you have a heavy number of items but if you don't its a waste.

There are signs all over our lot too, and at every retail outlet in Ohio, but the signs doesn't mean crap. Got a very good feeling its that way in almost everystate. It is a deterent for people not to sue, doesn't mean its going to hold up in court.
I can put a sign up in front of my house that states if you walk down my sidewalk I'm going to beat the sh*t out of you. Know what, if I really do, my sign isn't going to mean a thing is court.
